Man seeks $100k for 10-foot fall off scaffold

Attempting to lift some plywood while on a scaffold, Ramiro Ordonez lost his balance and plummeted 10 feet. He claims the scaffold's constructer, C.S. Quality Construction Inc., negligently failed to install toe boards and handrails and has filed suit.

Ordonez's suit was filed in the Jefferson County District Court on Feb. 4.

According to his petition, on May 10, 2007, Ordonez was working on scaffolding constructed by C.S.Quality Construction when he fell off while attempting to lift some plywood.

"The scaffolding was located 10 feet in the air and had neither toe boards nor handrails," the suit said. "The construction of the scaffolding violated the Occupational Safety Health Administration standards as well as proper and prudent practices within the construction industry."

The suit continues by alleging Quality Construction was negligent for failing to inspect the scaffolding, failing to provide fall protection and in failing to provide Ordonez a safe place to work.

"Quality Construction did not carry worker's compensation insurance that covered Plaintiff," the suit said. "Accordingly, if Plaintiff had the status of an employee, then CS Quality Construction, Inc. has waived its common law defenses to Plaintiff's claim."

Ordonez is suing for more than $100,000 in damages.

He is demanding a trial by jury and is represented by Steven C. Barkley, Attorney at Law.

Judge Bob Wortham, 60th Judicial District, has been assigned to the case.
