This Just In: Recent civil suits filed in Jefferson County District Courts

Feb. 28

  • Marilyn Stern-Duhon vs. Lamar Institute of Technology

    PA - Donald Hudgins, J - Donald Floyd

    While having some dental work done at the Lamar Institute of Technology, Marilyn Stern-Duhon tripped over an electrical-injunction box when she dismounted from a dental chair. She has filed suit against the college, claiming a Lamar dental technician forced her to exit the chair from the wrong side.

    She alleges LIT negligently caused her injuries by painting the electrical box with a color that resembled the floor's color. She further claims she has suffered permanent injuries to her knee and lumbar spine.

    Stern-Duhon is suing for actual and special damages, plus all court costs.

    G. David Colbert vs. Union Pacific Railroad Co.

    PA - Bristol Baxley, J - Bob Wortham

    A Union Pacific Railroad Co. employee has sued the company claiming that he was exposed to repetitive trauma during his career. G. David Colbert alleges his injuries were caused because UPR violated several federal regulations. Colbert worked in UPR's transportation department as a conductor and brakeman.

    Colbert is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses.

  • Paul Wilhelm et al vs. A.W. Chesterton et al

    PA - Lou Thompson Black, J - Gary Sanderson

    Paul A. Wilhelm is suing A.W. Chesterton, along with 29 other companies, for conspiring to mine, process and sell asbestos products, suppressing the information pertaining to the fiber's hazardous influence on human health, and purposely inflicting him with an asbestos disease.

    Wilhelm is suing for physical pain and suffering in the past and future, mental anguish in the past and future, lost wages, loss of earning capacity, disfigurement in the past and future, physical impairment in the past and future, and past and future medical expenses, including homecare costs.

    He also seeks punitive and exemplary damages.

  • Rodney Figueroa et al vs. Web Devices et al

    PA � Steven Barkley, J - Milton Shuffield

    A scaffold builder plummeted to the ground after his safety lanyard snapped. Seeking monetary compensation for his injuries, Rodney Figueroa, along with his wife Mellissa, have filed suit against the makers of the lanyard, the premises where he was working and his employer.

    The Figueroas are suing Web Dives for selling a faulty lanyard, Valero Energy Corp. and The Brook Group (Rodney Figueroa's employer) for failing to provide him with a safe place to work.

  • Frances Devall vs. Jefferson Theater Preservation Society et al

    PA - Jill Chatelain, J - Bob Wortham

    Frances Devall says she was severely injured while attending a Lamar University production at the Jefferson Theater nearly two years ago. Seeking to recover more than $100,000 in medical expenses, Devall filed suit against the Jefferson Theater Preservation Society and the Venuetech Management Group. Devall's suit does not state how she was injured during the production. The suit only state that "Defendants were in control of the premises � and owed Plaintiff a duty to exercise ordinary care."

  • Angela Broussard vs. the estate of Robert Phelps

    PA - Mark Sparks, J - Milton Shuffield

    Angela Broussard, 22, suffered from nausea and stomach cramps after having a cholecystectomy performed at the Medical Center of Southeast Texas last year. Now, Broussard has filed suit against the estate of Dr. Robert Phelps, the late surgeon who she claims botched her surgery by injuring her common bile duct.
