Herbert Martin is suing Globe Life Accident Insurance Co. for life insurance policy proceeds it allegedly refused to pay him. The policy was worth $20,000.
Martin's suit was filed in the Jefferson County District Court on March 12.
According to the plaintiff's petition, on July 10, 2003, Globe Life issued a life insurance policy in the amount of $20,000 insuring the life of Charles Piazza. The Policy listed Martin as the beneficiary. Piazza died on Sept. 19, 2006, during a time in which the policy was in full force and effect.
"Plaintiff has met all conditions precedent regarding presentation of a claim to Defendant under the Policy," the suit said. "Defendant, despite notice and demand, has failed and refused to pay any amounts due Plaintiff under the Policy."
The suit continues by alleging Globe Life failed to investigate the facts surrounding the death of the insured in good faith.
"Defendant's acts and/or omissions constitute acts of bad faith, unfair claims settlement practices and unfair trade practices in violation of law," the suit said. "All of the above and foregoing acts of Defendant were done knowingly and with the purpose to avoid payment of a just claim."
Martin is suing for the policy amount, interest, punitive damages and attorney's fees.
He is represented by Nathan Reynolds, Attorney at Law.
