This Just In: Recent civil suits filed in Jefferson County District Courts

May 13

  • Bethany Henry et al vs. Rikki Ferguson et al

    PA � Mathew Matheny, J � Donald Floyd

    Henry and Marqueta Randall have filed suit against Ferguson and Ashley Deanda, alleging the defendants negligently caused an automobile collision on Dec. 21, 2007. The suit does not state where or how the collision occurred. However, the suit states the defendants were negligent for allegedly failing to control their speed, maintain a proper lookout and apply their brakes in a timely manner.

    The plaintiffs are suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Hallie McCracken vs. Sylvia Watts

    The plaintiff is suing the defendant for allegedly negligently causing an automobile collision on Dec. 26, 2007. The suit does not state where or how the collision occurred. However, the suit states the defendant was negligent for allegedly failing to control her speed, maintain a proper lookout and apply her brakes in a timely manner.

    The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Michael McMillian vs. Weeks Marine et al

    McMillian has filed suit against Weeks Marine and one of its employees, Walter Pike Jr., who allegedly caused an automobile collision through negligence on Feb. 21, 2008. Pike was traveling southbound on SH 82 while McMillian was traveling Northbound.

    Pike allegedly failed to yield the right-of-way while making a left turn, hitting McMillian's vehicle.

    The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Preston Bank vs. Empire Indemnity Insurance Co. et al

    Bank is suing Empire Indemnity for allegedly failing to pay at least a portion of his Hurricane Rita property damage claim. The suit also names ZC Insurance Agency Inc., Custard Insurance Adjusters Inc. and Graig Taylor as defendants.

    The suit alleges the defendants committed Texas insurance Code and DPTA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Ruby Clayton vs. Jaime Turner

    On June 6, 2006, Clayton was a passenger in a vehicle stopped at a red light on Gulf Drive when Turner allegedly hit his car from behind.

    The plaintiff is alleging the defendant failed to control the vehicle and is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Action Construction vs. Texas State Bank

    Action Construction, a customer of Texas Bank, is alleging an employee was cashing forged Action Construction checks, taking the company for $63,691.47. The plaintiff says the defendant was instructed not to cash stamped checks but did so anyway, breaching its contract.

    The plaintiff is suing for actual damages, interest and attorneys' fees.

  • Curtis Harper vs. Capital County Mutual Fire Insurance Co.

    PA � Barrett Lindsay, J � Milton Shuffield

    Harper is suing CCMFI for allegedly failing to pay at least a portion of his Hurricane Humberto property damage claim. The suit alleges the defendant committed Texas insurance Code and DPTA violations.

    The plaintiff is suing for actual damages, plus attorneys' fees.

  • Sheilah Moss vs. Frank and Carol Jones

    PA � James Payne, J � Donald Floyd

    On Aug. 27, 2006, Moss says she was involved in an automobile collision with the Joneses.

    Moss was traveling east on Washington Boulevard when Frank Jones allegedly failed to yield the right-of-way.

    The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Miguel Licea et al vs. Conn's Appliances Inc. et al

    Licea and TJ Farms Partnership have filed suit against Conn's Appliance and one of its truck drivers, Errol Jackson, claiming the company negligently entrusted one of its vehicles to Jackson, who caused an automobile collision on Sept. 8, 2007, in San Patricio County.

    Licea was driving a TJ Partnership van. He says when Jackson negligently failed to control his vehicle and hit him, his van flipped several times -- completely totaling the vehicle.

    TJ Partnership is suing for actual damages. Licea is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • Mitzi Stevens vs. Texas Roadhouse

    PA - Travis McCall, J - Gary Sanderson

    While dining out at the Texas Roadhouse, Mitzi Stevens slipped and slid down the restaurant's wooden ramp, injuring her right knee. Stevens claims she had to undergo surgery the following day and has filed suit against the restaurant seeking monetary compensation.

    Stevens is suing for past and future mental anguish, lost earnings, impairment and medical expenses.

  • Andrew Bigler vs. Service Master Clean

    PA - Ryan White, J - Milton Shuffield

    After his Port Arthur home was ravaged by fire, Andrew Bigler hired Service Master Clean to restore several household items. While cleaning, Bigler alleges the company's employees swiped important financial documents and family photos. Bigler says he has fruitlessly attempted to contact Service Master about the alleged theft, leaving him with only a litigation option.

    Bigler is seeking unliquidated and actual damages, plus attorneys' fees.

  • Matthew Bickham vs. Interface Protective Coatings et al

    PA - George Mallios, J - Milton Shuffield

    A construction worker has filed suit against three different companies, claiming they had a responsibility to keep him from falling off a roof. Matthew Bickham filed his suit against Interface Protective Coatings, Toll Brothers Inc. and JRC Contracting Inc.

    Bickman is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses.

  • Keith Chisum vs. Derek Stray and Allstate Indemnity

    On Friday, July 6, 2007, Chisum was driving in the inside westbound lane of I-10 when Stray, who was stopped at the shoulder, strayed into the plaintiff's lane, negligently causing an automobile collision.

    The plaintiff is suing for past and future mental anguish, lost earnings, disfigurement, impairment and medical expenses, plus actual damages.

  • George Harris vs. William Fratus

    PA - Christopher Kirchmer, J - Donald Floyd

    A bereaved father is suing a local resident who he claims acted with a blatant disregard for the welfare of others and created a dangerous condition on his premises, which allegedly was the cause of his daughter's death. The suit, brought forward by George Harris on behalf of Alyssa Harris, was filed against William B. Fratus.

    Harris is seeking punitive and exemplary damages.

  • Steve and Theresa Clegg vs. Renaissance Remodeling

    PA � E. Hart Green, J � Bob Wortham

    The Cleggs hired Renaissance following Hurricane Rita. The couple alleged the defendant performed "shoddy" work on their property, breaching its contract.

    The plaintiffs are suing for actual and statutory damages under the DTPA. They are also suing for mental anguish and attorneys' fees.

  • Rosalind Green. Vs, Allstate Texas Lloyds et al

    PA � Michael Ramsey, J � Bob Wortham

    Green is suing Allstate and several of its claims adjusters for allegedly failing to pay at least a portion of her Hurricane Rita property damage claim.

    The suit alleges the defendants committed Texas insurance Code and DPTA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Alice Richard et al vs. Dr. John Schmidt

    PA � Brian Sutton, J � Milton Shuffield

    A 70-year-old man lost his life more than two years ago after undergoing hernia surgery. Now, the late Burton Richard's family is suing the doctor who performed the surgery for lost inheritance.

    Alice Richard, representing the estate of Burton, filed the Richard family's medical-malpractice suit against Dr. John Schmidt.

  • Richard Beaver vs. Kansas City Southern Railway et al

    PA � Bristol Baxley, - Gary Sanderson

    A Kansas City Southern Railway employee, Richard Baxley, has filed suit against his employer and Kinder Morgan Petcoke, claiming he was injured when a train derailed last year.

    The plaintiff is seeking exemplary damages.

  • Warren Holub vs. Helena Labs et al

    PA - Tony Malley, J - Gary Sanderson

    A benzene suit has been filed on the behalf of Sandra Sue Holub, who worked at Helena Laboratories in Jefferson County and was allegedly exposed to enough of the chemical to develop acute myelogenous leukemia.

    Warren Holub, Sandra's husband, filed his wrongful death suit against Helena Laboratories and seven other defendants, including Chevron USA and Huntsman Petrochemical.

    He is seeking survival damages.

  • Allison Redeaux vs. National Lloyds Insurance Co. et al

    PA � Steve Mostyn, J � Gary Sanderson

    Allison Redeaux filed suit against National Lloyds Insurance Co. and two of its agents claiming the insurance company low-balled her after she submitted her Rita property-damage claim.

    The plaintiff is suing for the unpaid claim, actual and compensatory damages, economic hardship, plus exemplary damages and damages for mental anguish.
