Seasoned with an unidentified "foreign object," a Hartford, Mich., woman claims she broke three teeth after chomping down on the UFO while dining at Logan's Roadhouse. She and her husband have filed suit against the restaurant.
Jody Wade and her husband Robert, who claims his wife's injury has also caused him damages, filed suit against Logan's June 5 in the Jefferson County District Court.
According to the couple's petition, on Jan. 25, 2007, Jody Wade was dining at Logan's Roadhouse with friends when she bit into a hard object in the salad she had ordered. "Biting down on the (UFO) instantly caused extreme pain and resulted in damage to at least three teeth, requiring extensive dental work."
"The following day Ms. Wade had to undergo temporary dental work to alleviate the pain and protect her teeth," the suit says. "She later had extensive dental work to repair the damage to her teeth and she is expected to undergo additional dental work in the future as a result of this injury."
The Wades allege Jody's injury occurred because the food was not reasonably prepared and inspected prior to consumption.
"The food in question was unreasonably fit for consumption in that it was adulterated by a deleterious object, exposing the consumer to potential injury and damages," the suit says.
"Defendant knew that foreign objects could be contained within the food allowing for incidents as occurred herein to happen. Defendant was negligent in the marketing, preparation, inspection, and serving of the food."
Jody is suing for past and future, emotional distress, mental anguish, loss of consortium, lost wages and medical expenses.
Her husband is suing for lost wages and all damages allowed to him under law.
They are represented by Houston attorney John Kahn.
Judge Bob Wortham, 58th Judicial District, has been assigned to the case.
