This Just In: Recent civil suits filed in Orange County District Courts

July 17

  • David Delassus et al vs. Todd Castle

    PA – Clay Dugas, J – Pat Clark

    Delasuss, individually and on behalf of his minor children, is suing Castle who allegedly was driving drunk and caused an automobile collision Dec. 16, 2007. The incident occurred on SH 12 in Mauriceville.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and are suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Angela Pitre vs. Genesis Chemicals Inc. and Fred Hynson

    PA – David Stiles III, J – Pat Clark

    On Sept. 29, 2006, the plaintiff was a passenger in a vehicle traveling on Interstate 10 when Hynson, driving a Genesis-owned tractor trailer, caused a multi-vehicle pileup when he allegedly failed to control his rate of speed.

    The plaintiff alleges the defendant failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Knight Transportation Inc. vs. Larry Hebert and McIntyre Trucking Co.

    PA – Ronald Bair, J – Dennis Powell

    On July 19, 2006, the plaintiff's tractor trailer was parked at the Pilot Truck Stop in Orange County when Hebert, a McIntyre employee, backed his tractor trailer into the plaintiff's. The plaintiff is suing for actual and economic damages.

  • Dorthy Bland vs. George Alexander

    PA – Jonathan Juhan, J – Buddy Hahn

    On Aug. 14, 2006, in Bridge City the plaintiff was making a left turn at a green light when the defendant allegedly ran a red light and slammed into plaintiff's vehicle.

    The plaintiff alleges the defendant failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Megan Norris vs. Bombarder Recreational Products Inc.

    PA – Brian Mazzola, J – Buddy Hahn

    Just a few weeks ago, Norris was riding shotgun on a Sea-Doo motorized watercraft when "she slipped off the rear of the watercraft directly into the path of the water thrust by the jet pump," which "penetrated her orifices," court papers say.

    Claiming the Sea-Doo was negligently designed, Norris filed suit against Bombarder Recreational Products. She is suing for punitive damages.

  • Layfette and Martha Granger vs. Shell Oil et al

    PA – Keith Hyde, J – Pat Clark

    Claiming he was exposed to benzene, Layfette Granger and his wife Martha have filed suit against Shell Oil and 28 other corporations.

    The suit does not state when Granger was exposed, where he was exposed or how he was exposed, nor does the suit describe his alleged injury.

    The plaintiffs are seeking punitive damages.

  • Fred Thompson et al vs. Amoco Chemical Co.

    PA – Darren Brown, J – Buddy Hahn

    A long-term DuPont de Nemours employee, Fred Thompson claims he was "needlessly exposed to benzene" throughout his career.
    Alleging his exposure inflicted him with Non-Hodgkin's Lymphoma, Thompson and his wife Darleen filed suit against Amoco Chemical Co. and 42 other chemical companies. The plaintiffs are seeking punitive damages.

  • Kim and Lloyd Gill vs. Palm Harbor Manufacturing

    PA – Tom Kiehnhoff, J – Pat Clark

    On March 19, 2003, the Gills claim they bought a new manufactured home from Palm Harbor. However, they allege they were actually sold a demo home which was not delivered and set up properly.

    The plaintiffs claim their home is prone to water damage because of the defendant's alleged negligence. They are suing for actual and economic damages.

  • Terri Franklin vs. Ford Motor Company

    PA – David Dies, J – Buddy Hahn

    After her vehicle was splattered with pieces of blown tire from the vehicle in front of her, Terri Franklin lost control and flipped her vehicle. Franklin claims the tire was negligently manufactured by Firestone.

    Franklin's suit also faults Ford Motor Co. for equipping the tire as a spare on its Explorer and further names Shannon Franklin, the driver in front of her, as a defendant. She is suing for punitive damages.
