This Just In: Recent civil suits filed in Jefferson County District Courts

Sept. 4

  • Harvey Williams vs. A.W. Chesterton

    PA – Lou Thompson Black, J – Donald Floyd

    Harvey Williams vs. A.W. Chesterton, faults 53 companies for allegedly conspiring to conceal the hazards of asbestos.

    In his suit, Williams alleges the corporate defendants maliciously inflicted him with an asbestos-related disease by manufacturing, selling and using asbestos products. He is suing for punitive damages.

  • KaSandra Johnson et al vs. Cedarridge Apartments et al

    PA - Roger Merrill, J - Milton Shuffield

    More than two years ago, a gate at the Cedarridge Apartments became unhinged and landed on a minor child.

    On behalf of her minor daughter, KaSandra Johnson filed a suit against the apartment complex, Itex Property Management and Meyer Smith, Inc.

    The plaintiffs are suing for mental anguish, pain and medical expenses, plus all court costs.

  • Curtis Blake Phillips et al vs. Exxon Mobil Corp. et al

    PA – Keith Hyde, J – Milton Shuffield

    The children of deceased Exxon Mobil employee Omar Phillips blame the company for exposing their father to asbestos dust and fibers during his career as a pipe fitter and welder.

    Curtis Blake Phillips and Beverly Babin allege the company knew of the hazards of asbestos-containing products, but failed to warn employees or protect them from exposure. The plaintiffs claim the asbestos exposure caused their father's death from lung cancer in 2007.

    They seek punitive damages.

  • Holli Johnson vs. Macy's Department Store

    PA – James Payne, J – Milton Shuffield

    On April 14, plaintiff Holli Johnson was exiting Macy's at Parkdale Mall when she was stopped for shoplifting.

    She claims the security guard used excessive force and threw her to the ground where she injured her head.

    Johnson seeks damages for medical expense, pain, suffering, mental anguish and interest.

  • Patricia Rodrigue vs. Headwaters Construction Materials LLC et al

    PA – Steve Barkley, J – Donald Floyd

    Plaintiff Patricia Rodrigue worked checking trucks as they entered the Motiva refinery in Port Arthur. She claims that on Sept. 5, 2006, she mounted the steps of a truck owned by Headwaters Construction to check the driver's paperwork. Allegedly, the driver popped the clutch, which caused her to fall off and land in a ditch.

    She sustained injuries to her right wrist and shoulder and has undergone surgery on her wrist.

    The suit claims the construction company was responsible for the driver's negligence and that Motiva was negligent for having the ditch there and not adequately maintaining it.

  • Donald Moss vs. Kashi Bagri M.D.

    PA – Ken Lewis, J – Milton Shuffield

    Plaintiff Donald Moss was referred to psychiatrist Dr. Kashi Bagri for treatment of depression and anxiety. Moss also had a history of diabetes.

    Bagri prescribed Geodon to Moss, a drug approved for bipolar disorder and schizophrenia. Moss later developed serious motor disorders, including tardive dyskenisia.

    The suit alleges that Bagri's choice of Geodon for an off-label use to treat depression was inappropriate and is the cause of Moss' permanent disabilities.

  • Russell Cerami et al vs. Huntsman Petrochemical et al

    PA – Dale Hanks, J – Bob Wortham

    A Mississippi resident who grew up in Groves says his brain cancer is an infliction brought on by being exposed to butadiene "emitting from the SBR complex in Port Neches."

    Through attorney Dale Hanks, Russell Cerami and his wife Terry filed a lawsuit against Huntsman Petrochemical and 29 other companies.

    On top of punitive and actual damages, Cerami is suing for past and future mental anguish, medical expenses, physical impairment and disfigurement. His wife is suing for loss of consortium.

  • Ada Goins et al vs. E.I. DuPont De Nemours et al

    PA - Matthew Willis, J - Gary Sanderson

    Fore more than 40 years, Jimmy Wayne Goins worked at local industrial facilities. Within the last two years, Goins contracted leukemia and died. His wife, Ada Goins, claims 13 companies are responsible for his death and filed a benzene suit. Some of the in suit defendants include DuPont, Texaco, Chevron USA and Huntsman Petrochemical.

    Goins' wife is suing for his past and future mental anguish, medical expenses and lost wages, plus loss of consortium and punitive damages.

  • Stephanie Fertitta vs. Tim Berryhill

    PA – Adam Terrell, J – Bob Wortham

    A woman claiming she didn't know 4-wheelers were dangerous is suing the man who let her ride one for not warning her she could get hurt.

    Seeking damages for mental anguish and medical expenses, Stephanie Fertitta filed her suit against Tim Berryhill.

  • Adrienne Casimire vs. McDonalds

    PA – Ken Lewis, J – Milton Shuffield

    While coming out of the rain into a McDonald's, Adrienne Casimire slipped in a puddle of water. She is suing the fast food restaurant, claiming the establishment negligently failed to warn her.

    Casimire is suing for past and future mental anguish, medical expenses and pain.
