Woman claims man in rental car caused pile-up

A woman says she was seriously injured in a multiple car collision after a man failed to stop at a light.

Nevah Price filed a lawsuit June 8 in Jefferson County District Court against Avis Rent A Car and David Gomez.

Price says she was stopped in traffic at a stop light at 8800 Ninth Ave. in Port Arthur when the collision occurred.

Gomez was driving a few cars behind Price when he failed to control his speed and struck the vehicle behind Price, causing it to collide into her vehicle and making her hit the car in front of her, according to the complaint.

At the scene, Gomez was charged with failure to control his speed, the suit states.

At the time of the collision, Gomez was driving a car he rented from Avis Rent A Car.

Because of the collision, Price incurred medical costs and experienced physical pain, suffering, physical impairment, loss of earning capacity, loss of consortium, loss of household services and mental anguish, the complaint says.

She claims Gomez negligently failed to keep a proper lookout and drove too fast for road conditions.

Avis Rent A Car is liable because it should have known Gomez was a reckless driver, the complaint says.

Price is seeking an unspecified judgment and unspecified exemplary damages, interest, costs and other relief to which she may be entitled.

Pat McGinnis of Beaumont will be representing her.

The case has been assigned to Judge Milton Shuffield, 136th District Court.

Jefferson County District Court case number: D184-241.
