Woman seeks insurance payment for collision with underinsured motorist

A woman is suing her insurance company after she says it will not pay her for damages under her underinsured motorist policy.
Rachel Louise Jeffcoat filed a lawsuit Aug. 5 in Jefferson County District Court against Southern Farm Bureau Casualty Insurance Company.

Jeffcoat claims she was involved in an automobile collision on Aug. 6, 2005, with a vehicle owned by Samuel O. Simon and driven by Andy Todd Williams.

According to the complaint, the plaintiff alleges the accident was Williams' fault because he failed to keep a proper lookout, failed to maintain control of the vehicle, drove too fast, failed to apply the brakes to avoid a collision, failed to exercise ordinary care and failed to maintain a safe distance.

At the time of the accident, Jeffcoat had an insurance policy with Southern Farm and claims he was supposed to be covered if the driver of the vehicle was uninsured or underinsured, as Williams was, the suit states.

Even though Jeffcoat claims she has fully complied with all requirements under the policy, she says Southern Farm has refused to pay her for her damages, which include medical expenses, pain and suffering, mental anguish, loss of earnings, physical impairment and automobile repair expenses.

Jeffcoat is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief to which she may be entitled.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing her.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
