Attorney duel: Brent Coon wants back rent from lawyer tenant

A big fish in litigation against a smaller fish says a tenant on his property is on the hook for hundreds of thousands of dollars in back rent.

In March 2008, Brent Coon and his company Brentwood Investment filed suit in hopes of recovering $214,933 in back rent form real estate lawyer Thomas Sibley, who rents an office from Coon at his Tuscany Park office park located at 3450 Dowlen Road.

Both parties since have filed motions for summary judgment. A hearing slated for Monday, Oct. 5, was reset at the last moment and rescheduled for sometime in late October.

In his motion for summary judgment, Sibley argues that his "lease is unsigned by landlord Brent Coon" and is therefore "defective on its face as a matter of law."

"No written contract exists," Sibley argues in his motion. "Neither Brent Coon, nor any other agent (from his company), has complied with that lease provision."

Coon is relying on the affidavit of Sam Parigi Jr. in his support of his motion for summary judgment.

Parigi is a Beaumont real estate agent who says in his affidavit that a lease agreement does indeed exist between the two parties.

This is not the first Tuscany Park tenant that Coon has taken legal action against. Earlier this year, Coon evicted The Pablano Grill from the shopping and business center due to its unpaid rent.

Coon is represented by attorney Jason Hughes of the Germer Gertz law firm.

Sibley is representing himself.

Judge Bob Wortham, 58th Judicial District, is presiding over the case.
