Railroad worker blames fall on uneven track

A Doucette man has filed suit against Union Pacific Railroad Co., alleging he was injured while walking on uneven footing near train tracks.

Gerald W. West claims he injured his left ankle on Dec. 28, 2007, because of uneven footing along the track where he was assigned to work.

Because of his injuries, West suffered great physical and mental pain and anguish, lost earnings and benefits and experienced a physical impairment, according to the complaint filed Nov. 16 in Jefferson County District Court.

In addition, he incurred medical costs and suffered disfigurement, the suit states.

Union Pacific negligently failed to provide West with a safe place to work and failed to provide safe terrain on which to walk, the complaint says.

West is seeking exemplary and punitive damages, plus post-judgment interest, costs and other relief to which he may be entitled.

He will be represented by David P. Wilson and Matthew C. Matheny of Provost Umphrey Law Firm in Beaumont.

The case has been assigned to Judge Bob Wortham, 58th District Court.
