This Just In: Recent civil suits filed in Jefferson County District Courts

Jan. 13

  • Charles Hermsen vs. Fire Insurance Exchange

    PA - Steve Mostyn, J - Gary Sanderson

    The plaintiff is suing the insurance company for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Longfellow of Ohio vs. J&W Travis Enterprises

    PA - Kerwin Stone, J - Milton Shuffield

    The owner of a Jefferson County apartment complex has filed suit against a contractor, alleging it lost rent after the contractor failed to complete work in a timely manner.

    Longfellow of Ohio, which owns Longfellow Apartments in Beaumont, claims it hired J&W Travis Enterprises to perform repairs and renovations to its apartments.

    According to the complaint, the work was to be completed within 20 weeks from the time the contract was signed on Dec. 10, 2008.

    However, Longfellow alleges J&W Travis Enterprises failed to complete the work on time, failed to perform the work in a good and workmanlike manner, failed to pay its subcontractors and suppliers, failed to properly man the job, failed to complete the contract and failed to honor warranties, the suit states.

  • Paul Parfait vs. Danielle Marine Towing

    On April 13, 2009, the plaintiff was a seaman serving aboard the defendant's vessel when he was injured.

    The suit does not state how he was injured.

    Under the Jones Act, the plaintiff is seeking damages for medical costs, lost earning capacity, lost wages, mental anguish, physical pain, suffering, physical impairment and disfigurement.

  • Lenora Fawcett vs. Stephen and Kimberly Young

    A Groves woman claims her granddaughter sold her home without her knowledge and only gave her $6,000 from the $148,000 transaction.

    Lenora Fawcett filed a lawsuit in Jefferson County District Court against Stephen and Kimberly Young.

    Fawcett claims she built a house on property belonging to her daughter and son-in-law, Deborah and Donald Avery, in 1999.

    According to the complaint, Fawcett paid for the house with cash proceeds from a stock sale and moved into the new home on Memorial Day 2000.

    A year later, Donald Avery died and left his entire estate to his wife, the suit states.

    In turn, Deborah Avery deeded the property to Fawcett's granddaughter, Kimberly Young, and her husband, Stephen Young.

    Although Avery deeded the property to the Youngs, Fawcett says she continued to live in the home with no problems until April 2009 when she fell and became hospitalized.

  • Angela Creel vs. Dr. Pradip Morbia et al

    A Port Neches woman claims she was assaulted by a Port Arthur doctor during an examination.

    Angela Creel filed a lawsuit Jan. 14 in Jefferson County District Court against Dr. Pradip J. Morbia and Gulf Coast Cardiology Group.

    Creel says she sought medical care from Morbia on Feb. 11 when, during the course of an exam, Morbia assaulted Creel.

    Because of the assault, Creel suffered physical, emotional and mental pain, suffering and anguish; incurred medical costs; and has been impaired from earning an income, according to the complaint. In addition, the unspecified medical condition for which she was seeking care has greatly deteriorated, the suit states.

  • Teri Segura vs. Countrywide Home Loans

    After Hurricane Rita cut a swath through Southeast Texas, Countrywide granted several Golden triangle residents a reprieve from making monthly mortgage payments.

    Now more than four years later, Countrywide is seeking to collect on those back payments. The plaintiff claims Countrywide misrepresented the conditions of the payment suspension program and is now unfairly requesting a lump sum payment plus additional late fees.
