Man standing by parked vehicle sues driver who struck him

A Beaumont man has filed suit against the driver who he says struck him as he was standing near a parked vehicle.

Benjamin Alvarado claims he was struck by defendant Matthew Falgout on March 18, 2008, in Beaumont after Falgout failed to safely move his parked vehicle.

Because of the incident, Alvarado incurred medical costs; lost earnings and his earning capacity; and suffered physical impairment, physical pain and mental anguish, according to the complaint filed Feb. 24 in Jefferson County District Court.

Falgout negligently failed to keep a proper lookout and drove in disregard for the safety of others, the suit states.

Alvarado is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief to which he may be entitled.

Jonathan C. Juhan of Beaumont will be representing him.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
