Orange County woman sues alleged red light runner

An Orange County woman has filed suit against the driver she says struck her after the driver failed to stop for a red light.

Ashley Loya claims she suffered severe injuries in a collision that occurred on Dec. 13. Loya does not mention where the collision happened, but did filed her suit March 3 in Jefferson County District Court.

In addition to her injuries, Loya incurred medical costs, experienced physical pain and mental anguish, lost wages and suffered a damage to her earning capacity because of the accident, the suit states. In addition, she experienced disfigurement and physical impairment and incurred property damages, the complaint says.

Loya blames defendant Smita Shailesh Patel for causing the accident, saying she failed to control her speed, failed to maintain a proper lookout, failed to timely apply her brakes, failed to drive in a safe manner, failed to maintain control of her vehicle, failed to yield the right-of-way and disregarded a red light.

In her complaint, Loya seeks actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief to which she may be entitled.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
