Suit claims man assaulted by car wash employees

A Jefferson County man claims while he visited a Beaumont car wash he was physically assaulted by its employees.

Jerry Norris filed a lawsuit April 15 in Jefferson County District Court against Simoniz Car Wash, Wash Depot, Wash Depot employees Cyrus Cane and Richard Bellard and manager Chris Stacks.

Norris claims Cane and Bellard attacked him on April 22, 2008, while they worked at the car wash. Stacks, the manager of the business, failed to intervene and allowed their attack to continue, according to the complaint.

Because of the attack, Norris incurred medical costs, experienced physical pain and suffering, sustained mental anguish and lost earnings, the suit states. In addition, he sustained physical impairment, the complaint says.

Norris blames Simoniz for failing to monitor its employees, for retaining employees, for failing to stop employees from assaulting him, for negligent hiring and for a negligent background search.

Norris seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
