Driver ran stop sign, suit claims
A man claims he sustained severe neck, back and left shoulder pain after a driver failed to yield the right-of-way at a stop sign.
Eric McCauley filed a lawsuit April 23 in Jefferson County District Court against Kenneth Mike Jeane also known as Gary Michael Jeane.
McCauley claims he drove on Avenue D in Port Neches on May 16, 2008, when Jeane failed to yield at a stop sign and slammed into his vehicle.
In addition to his injuries, McCauley incurred medical costs; lost earnings and his earning capacity; suffered physical impairment, physical pain and mental anguish; and incurred property damages because of the collision, the complaint says.
He blames Jeane for failing to keep a proper lookout and for failing to stop at an intersection controlled by a stop sign.
In his complaint, McCauley seeks an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.
Jonathan C. Juhan of Beaumont will be representing him.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
