Suit filed over crash on Concord Road

A man claims he incurred medical costs after a driver failed to yield the right-of-way and struck him.

Ruben Loredo Alvarado filed a lawsuit April 20 in Jefferson County District Court against Alicia Francheska Batiste.

Alvarado claims he drove north on Concord Road in Beaumont on Oct. 7, 2008, when Batiste, who drove south on the same road, failed to yield the right-of-way to him while she attempted to turn into a private drive, causing a collision.

Because of the accident, Alvarado experienced physical pain, suffering and mental anguish; incurred medical costs; and incurred property damages, according to the complaint.

He blames Batiste for causing the collision, saying she failed to keep a proper lookout for his safety, failed to take evasive action to avoid a collision, failed to yield the right-of-way to oncoming traffic and failed to timely apply her brakes to avoid a collision.

Alvarado seeks a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, cost and other relief to which he may be entitled.

Thomas O. Moses of Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
