Steel supplier sues construction company over $100,000 debt

A Louisiana corporation has filed suit against a Cypress company, alleging it failed to pay more than $100,000 for goods it was delivered.

Sentry Supply Inc., doing business as Superior Supply and Steel, claims it delivered $105,410.18 worth of goods and merchandise to defendant McGuffy Energy Services.

Plaintiff Sentry Supply is a wholesale industrial supplies company based in Sulphur, La., which provides steel pipe and tubing and industrial machinery components and accessories, according to the company website.

According to its website, McGuffy Energy Services is a contracting company for oil, gas and power-related projects, including engineering design, fabrication and field construction.

According to the complaint filed May 5 in Jefferson County District Court, McGuffy failed to pay for the goods and now owes Sentry Supply $124,913.03, including interest at 18 percent per annum.

"That this Defendant accepted each item sold and delivered by the Plaintiff and became bound to pay the agreed and designated price, which is a reasonable, usual, and customary price for each item, as set forth in the statement of account that is incorporated in this petition by reference as if copied herein verbatim," the suit states.

"That Plaintiff has demanded payment from Defendant but this Defendant has failed and refused to pay the balance due on the account and more than 30 days have expired from the date that the balance owed became due and payable."

In its suit, Sentry Supply seeks the money it says McGuffy owes it, plus pre-judgment interest, at least $30,000 in attorney's fees, costs, post-judgment interest at the rate of 18 percent per year and other relief the court deems just.

Arnold V. Goldstein of Beaumont will be representing it.

The case has been assigned to Judge Bob Wortham, 58th District Court.
