A Nederland couple files suit against roofing company

A Nederland couple has filed suit against the company that installed their roof after they say they found severe deficiencies in the electrical, mechanical, plumbing and structural installation.

Mark and Karen Johnson claim they hired defendant Joe Ochoa Roofing to perform construction services on their home located at 2620 Spurlock in Nederland.

After Joe Ochoa Roofing performed the work, however, the Johnsons found multiple serious deficiencies and discovered the work was in violation of the National Electric Code, the Uniform Plumbing Code, the Internal Mechanical Code, the Internal Residential Code and the International Energy Conservation Code, according to the complaint filed June 1 in Jefferson County District Court. In addition, Joe Ochoa Roofing failed to obtain necessary permits for their construction work, the suit states.

"Plaintiffs allege that the construction work of Defendant Ochoa was subsequently inspected and that various serious deficiencies were discovered," the complaint says.

In their complaint, the Johnsons are seeking actual and exemplary damages, plus additional damages permitted under the Texas Deceptive Trade Practices -- Consumer Protection Act, pre- and post-judgment interest at the highest rate allowed by law, costs and other relief the court deems just.

Tommy L. Yeates of Moore Landrey in Beaumont will be representing them.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
