Nederland woman sues drivers who caused collision

A Nederland woman has filed suit suit against the drivers who caused a collision and forced her to incur medical costs.

Jennifer Perello claims she was riding in a vehicle defendant Ian T. Schwab was driving on SH 61 on June 13, 2008, when defendant Steven Lee Ferguson turned when it was not safe to do so.

"Defendant Ian T. Schwab failed to control his speed and slammed into the rear of Defendant Ferguson's vehicle," the suit filed June 8 in Jefferson County District Court states.

In addition to her medical costs, Perello lost her earnings and her earning capacity and suffered physical impairment, physical pain and mental anguish, according to the complaint.

Schwab negligently failed to keep a proper lookout, failed to apply his brakes to avoid the collision, failed to control his speed to avoid a collision and failed to maintain a clear distance between his vehicle and Ferguson's, the complaint says.

Perello also blames Ferguson for failing to keep a proper lookout and for failing to safely turn his vehicle into a private road or driveway. In addition, she names the owner of Schwab's vehicle, Mario Perello, as a defendant.

In her complaint, Perello is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief to which she may be entitled.

Jonathan C. Juhan of Beaumont will be representing her.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
