Store sued after PA woman falls

A woman has filed suit against a Port Arthur store after she says she sustained injuries when she slipped on a wet floor.

Willie Simien claims she was a customer at H.E.B. on Aug. 19, 2008, when she encountered a wet floor as she walked down an aisle. Simien fell and sustained injuries, causing her to incur medical costs; to experience physical pain, suffering, mental anguish and physical impairment; and to lose consortium, according to the complaint filed June 28 in Jefferson County District Court.

Simien accuses the store of negligence, saying it failed to properly maintain and replace its refrigeration machines, failed to hire competent employees, failed to provide proper warnings of a hazardous condition, allowed its employees to leave wet floors, failed to warn her of dangerous conditions, created an unreasonably dangerous condition to exist on its premises, failed to correct the dangerous condition, failed to warn business invitees of the dangerous condition and failed to maintain its floor in a safe condition.

In her complaint, Simien seeks a judgment in excess of the minimum requirements of Jefferson County District Court, plus costs, pre-judgment interest and other relief the court deems just.

Clint Brasher and Joe Muckleroy of Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
