French market sues over repeated leaks in metal roof

A Jefferson County market claims its metal roof leaks despite multiple efforts by a roofing company to repair the problem.

Larry Judice, doing business as Larry's French Market, filed a lawsuit Aug. 5 in Jefferson County District Court against Republic Powdered Metals, Woodford Commercial Roofing and the W.M. Anderson Company.

Judice claims that he hired the defendants to install a metal roof on his market at 3701 Pure Atlantic Highway in Groves in September 2006.

"The roof has subsequently leaked during heavy rainfall on numerous occasions, despite attempts by Defendant, Republic Powdered Metals, to repair it under the warranty which remains in effect," the suit states.

Judice alleges breach of contract, negligence and negligent misrepresentation and breach of express and implied warranties against the defendants, according to the complaint.

In his complaint, Judice seeks actual and additional damages, plus attorneys' fees, pre- and post-judgment interest and other relief the court deems just.

Bob K. Monk and Brandon P. Monk of The Monk Law Firm in Port Arthur will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.

Jefferson County District Court case number: A187-489.
