Supply company sues to collect $50K debt

A building supply company claims a Houston corporation owes it more than $50,000 for materials.

American Builders and Contractors Supply Co., doing business as ABC Supply, filed a lawsuit Aug. 9 in Jefferson County District Court against Nexgen Structures of Texas.

ABC claims it sold and delivered several items to Nexgen. In return, Nexgen promised to pay off the goods on their account, but never did, according to the complaint.

"After the allowance of all just and lawful offsets, payments and credits to Defendant as reflected in said account, the balance thereon of $51,431.66 is past due, and Defendant, though requested, has failed to pay the same or any part thereof to Plaintiff," the suit states.

In addition to the money it says Nexgen owes it, ABC seeks statutory pre-judgment interest at six percent per annum, post-judgment interest at the maximum statutory rate, costs, attorney's fees and other relief the court deems just.

Randall F. Adair and Daniel S. Bowns of Adair, Morris and Osborn in Dallas will be representing it.

The case has been assigned to Judge Bob Wortham, 58th District Court.
