Wreck at Gulf and Live Oak subject of suit

A Jefferson County resident claims he incurred medical costs after a driver failed to yield to the vehicle in which he rode, causing a collision.

Henry Aguillera filed a lawsuit Aug. 23 in Jefferson County District Court against Jerrell Boykins.

Aguillera claims he rode in a vehicle traveling south on Gulf Street at its intersection with Live Oak in Beaumont on July 22, 2009, when Boykins failed to yield at a stop-and-go signal, causing a collision.

Because of the accident, Aguillera experienced pain, suffering and mental anguish, lost his earning capacity and lost wages, according to the complaint.

Aguillera blames Boykins for causing the collision, saying Boykins negligently failed to maintain a proper lookout, failed to control his distance, failed to yield the right-of-way and failed to drive attentively.

In addition, Boykins negligently failed to timely apply his brakes, failed to control his speed, failed to change lanes in a safe manner, failed to maneuver to avoid a collision and drove without a valid driver's license, the suit states.

In his complaint, Aguillera seeks actual and special damages, plus costs, pre- and post-judgment interest and other relief to which he may be entitled.

Norman L. Straub and Jonathan B. Zumwalt of Mestemaker and Straub in Houston will be representing him.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
