Mother, daughter mauled by pit bulls, sue owners

Alleging they were mauled by a pair of pit bulls, a mother and daughter have filed suit against the dogs' owners.

Joanna Macaluso and her daughter, Tiffany, filed the suit against Joe Jackson Jr. and Eleatar Jackson on Aug. 30 in Jefferson County District Court.

According to the petition, on May 18 Tiffany "was violently attacked by two unrestrained and unfenced pit bull dogs owned by defendants ... as she walked down Kenneth Avenue, despite no provocation whatsoever on her part."

"The dogs mauled Tiffany Macaluso and targeted her face, head and neck in an obvious effort to subdue and kill her just as this breed of canine is known to do," the suit states, adding that Joanna was also "brutally attacked" as she attempted to rescue her daughter.

The suit continues by alleging the dogs refused to obey Eleatar's verbal commands to stop and also attacked the investigating officer.

The suit does not state how the dogs were stopped.

The Macalusos allege the Jacksons were negligent for "failing to post a written warning to advise individuals that the dogs were present on the premises," and for failing to confine the dogs.

They are suing for past and future mental anguish, medical expenses, impairment, disfigurement and loss of earning capacity, plus exemplary damages.

The Macalusos are represented by Beaumont attorney Jonathan Juhan.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
