Kroger sued after employee falls

SHERMAN-A Lewisville resident has filed a lawsuit against his employer after he was injured when he slipped and fell on water in the freezer.

Sergio Carlos Serrano-Cordero; Consuelo Mora-Garcia, individually and as next friend of Sergio Cordero Mora; Jose Cordero Mora and Cassandra Cordero Mora, minors; and Alex Ivan Cordero Mora; filed suit against The Kroger Co. on June 19 in Denton County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on Sept. 17.

The employee states he was seriously injured as a result of the fall on the premises of the Kroger in Carrollton.

The defendant is accused of negligence by failing to provide adequate training to employees in maintaining the premises, failing to install, maintain and uses safeguards such as slip resistant floor mats, to protect employees against possible dangerous conditions, failing to provide proper training, implement proper and safe methods of sanitation and failing to adequately supervise employees to ensure that they are performing their job duties.

According to the complaint, the plaintiffs told Kroger they would settle the lawsuit for $150,000.

The petitioners are seeking damages for physical impairment, medical expenses, physical pain, mental anguish, loss of earnings, loss of earning capacity, loss of consortium, emotional distress, interest, court costs and attorneys' fees.

The plaintiff is represented by Kimberly A. Stovall of Stovall & Associates in Dallas.
