Tyson employee sues after job-related accident

MARSHALL-A Nacogdoches resident is suing Tyson Foods for more than $75,000 after he was injured in a job-related accident.

Hector Garcia filed suit against Tyson Foods Inc. on Sept. 14 in the Eastern District of Texas, Marshall Division.

Garcia states he was injured due to the negligence of Tyson's management, co-employees or Tyson's equipment on Sept. 16, 2008. The lawsuit does not detail how he was injured.

The defendant is accused of negligence for failing to exercise due care and caution, failing to keep a proper lookout, failing to use the appropriate method for maneuvering the equipment, failing to exercise appropriate safety procedures and provide appropriate training or safety equipment.

The plaintiff is seeking damages for physical pain, mental anguish, physical impairment, emotional distress, medical expenses, loss household services, physical disability, interest and court costs.

Garcia is represented by Reese P. Andrews of Andrews & Andrews in Nacogdoches.

U.S. District Judge David Folsom is assigned to the case.
