Woman claims driver rear-ended her on interstate

A woman has filed suit against the driver who she claims rear-ended her vehicle as she sat stopped on the interstate.

Alyssa Whiddon claims she was stopped in the westbound lanes of Interstate 10 in Jefferson County on Oct. 29 when defendant Joshua Price, who was driving an F350 truck owned by defendants Epic Communications and MTSI, failed to control his speed and ran into the back of her vehicle.

Because of the collision, Whiddon incurred medical costs; suffered physical pain, mental anguish, physical impairment and physical disfigurement; and lost earnings and his earning capacity, according to the complaint filed Nov. 18 in Jefferson County District Court.

Price negligently failed to timely apply his brakes, failed to maintain proper control of his vehicle, failed to take proper evasive action and failed to control his speed, the suit states. In addition, he negligently failed to maintain a proper lookout, failed to use reasonable care and failed to stay alert, the complaint says.

Whiddon blames Epic Communications and MTSI for also contributing to the accident, saying they negligently failed to provide proper driver training, failed to employ a safe driver, failed to employ a qualified driver, negligently entrusted their vehicle, failed to have a proper accident prevention program in place and failed to have a proper driver recruitment program in place.

In her complaint, Whiddon is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.
