Man sues van driver, owner over collision

A Pennsylvania man has filed suit against the Port Arthur driver and owner of a van he claims struck his vehicle.
Daniel Foster claims he was driving on Nov. 27, 2008, when his vehicle was struck by defendant Christopher Bul, who was driving a 2006 Chevy G2500 van owned by defendant Nick Tran.
Because of the collision, Foster experienced physical pain, suffering, mental anguish and physical impairment and lost wages, according to the complaint filed Nov. 24 in Jefferson County District Court. In addition, he incurred medical costs, the suit states.
Bul negligently failed to keep a proper lookout, failed to look for traffic, failed to control his speed, failed to maintain a safe stopping distance, failed to apply his brakes and lost control of his vehicle, the complaint says. Foster also blames Bul for driving in a harmful manner and for driving in a way that could harm others.
Tran should never have entrusted his vehicle to Bul, a driver who he should have known to be reckless and incompetent, according to the complaint.
In his complaint, Foster is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest at the legal rate, costs, damages and other relief the court deems just.
