Resort sued for failure to pay for hurricane repairs

GALVESTON - National Catastrophe Services Inc. claims that Silverleaf Resorts Inc. owes it $60,345 for a variety of services performed after Hurricane Ike, recent court documents say.

According to a lawsuit filed Dec. 15 in Galveston County District Court, Silverleaf hired the complainant to do cleaning, drying and demolition work at its premises near Galveston's San Luis Pass, which sustained damage during the Category 2 storm's landfall in early September 2008.

Both parties reportedly agreed to a payment system, including a clause stating that a 1.5 per cent late charge would be imposed on the monthly balance should the payment be remitted beyond 30 days.

NCS argues that the defendant, however, refused to pay for the services thus broke the agreement. The plaintiff, relying upon Silverleaf's representations, even gave up the opportunity to provide said services to another party, the original complaint insists.

The suit shows all attempts to resolve the debt were unsuccessful.

The Fusselman Law Firm P.C. is representing NCS, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
