Wreck on Galveston seawall subject of lawsuit

GALVESTON - Mark and Alane McClain of Orange are suing Frederick Josephson and Esther Tegge of Galveston over a car accident a year ago on the Galveston Seawall.

The McClains filed suit on Dec. 15 in Galveston County District Court, stating that defendant Josephson rear-ended them on May 16, 2009.

Mark McClain was driving a 2000 Isuzu Rodeo with Alane McClain as his passenger eastbound in the 3900 block of Seawall Boulevard when a 1993 Ford Ranger driven by Josephson struck the plaintiffs' vehicle in the rear, according to the original petition.

The suit faults Josephson for not controlling his speed, not keeping a proper lookout and failing to avoid the incident in question. It blames Tegge for negligently entrusting her vehicle to Josephson.

Consequently, Mark McClain sustained injuries to his lower back, right knee and neck while Alane McClain hurt her neck and lower back, court papers say.

They seek unspecified monetary damages and a jury trial.

Attorney David LaRue of Beaumont is representing the plaintiffs, and Galveston County 10th District Court Judge David Garner is presiding over the case.
