Woman falls off stool, sues Dickinson establishment

GALVESTON - Holly C. Roell claims that she hurt herself two years ago as she tried to sit on a stool at a Dickinson establishment, recent court documents say.

Roell sued then-owner of the premises Patrick C. Restivo and the current-owners Chuck Schmidt and Joseph Shipley on Dec. 6 in Galveston County Court at Law No. 2.

According to the complaint, Roell entered the premises to order a cup of coffee and fell as she attempted to take a seat.

She claims the place was dimly lit and the stool was too high.

She accuses the defendants of not properly addressing the lighting situation, neglecting to replace the reportedly dangerous stool and failing to warn her about any potential dangers thus seeks unspecified monetary damages.

Attorney Gerson D. Bloom of Galveston is representing Roell.

The case has been assigned to Galveston County Court at Law No. 2 Judge C.G. "Trey" Dibrell III.
