Garland residents sued over auto wreck

Beaumont local Nyree Banks has filed suit against Garland residents Baldemar and Lorena Gutierrez over a January 2009 automobile collision.

The suit was filed Dec. 21 in Jefferson County District Court.

According to the petition, on Jan. 14, 2009, Banks was traveling east on U.S. 90 in Beaumont when Baldemar, driving a vehicle insured by Lorena, changed "lanes when unsafe and slammed twice into plaintiff's vehicle."

Banks accuses Baldemar of negligently failing to keep a proper lookout and safely change lanes. He further accuses Lorena of negligent entrustment.

Banks is suing for past and future mental anguish, lost wages, impairment, medical expenses and pain, plus property damages.

The plaintiff is represented by Beaumont attorney Jonathan Juhan.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
