Woman slams into container, sues owner

GALVESTON � After colliding with a construction container more than a year ago, Harriet Toledo of Texas City is pursuing litigation against the container's owner.

In a lawsuit filed Jan. 28 in Galveston County District Court, Toledo blames Cherry Demolition Inc. for leaving its equipment in the roadway.

According to the original complaint, Toledo claims the container was near the intersection of Buttonwood Drive and Vicksburg Avenue in Texas on Aug. 10, 2009.

The plaintiff claims that the container was in an unlighted area and there were no warning signs or reflective devices.

Toledo says she suffered serious bodily injuries from her collision with the container.

She seeks unspecified monetary damages and a jury trial.

The Law Offices of Kerry L. Neves is representing the plaintiff, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
