After being struck by an uninsured motorist, Louisiana resident Linda Johnson submitted a claim to her insurance company, Allstate Fire & Casualty, who allegedly refused to pay for her alleged pain and suffering and some medical expenses.
Johnson filed suit against Allstate on May 2 in Jefferson County District Court. Allstate agent Tonja Hess, who handled her claim, is also a defendant in the suit.
Court records show that on May 3, 2009, Johnson was traveling on Lucas in Beaumont when an underinsured motorist struck her.
Under her policy, Johnson submitted a claim for the full amount of her benefits but was denied by Hess.
Hess allegedly refused to consider some of Johnson's medical bills and refused to make a reasonable offer to settle her policy claim, court papers say.
The suit accuses Allstate of breaching its contract and committing insurance code violations.
Johnson is suing for statutory damages and all court costs, including attorney's fees.
Beaumont attorney Jonathan Juhan represents her.
Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
