GALVESTON - A Houston man claims he was injured by the manager of a Kemah steakhouse, recent court documents say.
Justin Turner is suing Restaurants U.S. Enterprises, doing business as T-Bone Tom's, and Bruce Cote for what he describes as "excessive force" applied to him on Dec. 15, 2010.
The suit was filed April 26 in Galveston County District Court.
According to the complaint, Turner was a customer at T-Bone Tom's when Cote, who was acting in the course and scope of his employment, applied excessive force and inflicted him with bodily injuries.
"The defendants, its agents, servants and employees knew or in the exercise of ordinary care, should have known that their negligent conduct would cause injuries to their guests, including the plaintiff," it says.
Turner blames the defendants for failing to properly maintain the premises and failing to train, hire and supervise competent staff.
Consequently, he sues for severe physical and mental pain, suffering and anguish. A jury trial is also requested.
Attorney Roy Camberg of Houston is representing Turner.
Galveston County 10th District Court Judge David Garner is presiding over the case.
