Buzbee non-suits consultant's case over BP litigation fees

GALVESTON � Galveston attorney Tony Buzbee is asking a local state judge to grant his notice of nonsuit in a case over consulting fees and BP Deepwater Horizon litigation.

Buzbee filed a notice of nonsuit without prejudice in his lawsuit against Florida resident Kevin Schneider on April 28 before Galveston County 405th District Court Judge Wayne Mallia.

Schneider was the subject of a declaratory judgment request entered by Buzbee in the same court last Jan. 28. Court papers allege the defendant threatened Buzbee and his law firm with litigation if they did not give him compensation for his work done as a consultant.

Buzbee asked Mallia to rule that Schneider is not entitled to a consulting fee since the law firm did not accept his services.

According to Buzbee's original petition, Schneider claims he met with attorneys from the Buzbee firm and was offered pay in exchange for his help with suits arising from last year's Deepwater Horizon explosion.

The plaintiff, however, claims Schneider's statements are false and insists the law firm did not enter into any agreement with the defendant thus no fraud on its part was committed.

The defendant did not file an original answer challenging Buzbee's accusations.

Buzbee represented himself in the case.
