A mediator recently filed a letter notifying a Beaumont judge that H-E-B Grocery had settled a slip-and-fall lawsuit.
As previously reported, Jefferson County resident Earlene Stewart sued H-E-B Grocery in September, claiming she slipped and fell on an unidentified liquid substance lingering near the store's entrance.
H-E-B answered the suit on Oct. 11, denying all of Stewart's allegations and asserting the incident was caused by a third party or her own negligence.
However, on April 14 mediator James Mehaffy filed a letter stating that the parties had reached a settlement agreement.
As of May 16, no settlement agreement is on file.
According to her complaint, Stewart was shopping at the H-E-B on 11th Street in Beaumont on June 5 "when she slipped in a liquid substance on the floor of defendant's premises."
Stewart claims she "was exercising reasonable care for her own safety" and that the liquid substance "posed an unreasonable risk of harm" to shoppers, court papers show.
She alleges that because H-E-B negligently failed to maintain its premises in a safe condition, she seriously injured her wrist, shoulder, hip, back and spine.
Beaumont attorney Gilbert T. Adams III represented Stewart.
Mehaffy Weber attorney M.C. Carrington of Beaumont represented the grocery store.
Judge Bob Wortham, 58th District Court, presided over the case.
