Port Arthur residents in litigation over car crash
A Port Arthur man filed suit against the driver who he claims rear-ended his vehicle.
Jerry Wayne Bonin claims he came to a complete stop at the 3200 block of 32nd Street on May 10, 2010, when Troy Edward Handy Jr., also of Port Arthur, who was driving behind him, failed to control his speed and rear-ended Bonin.
Because of the collision, Bonin suffered injuries to his neck, experienced numbness and tingling down his left arm and incurred headaches and back pain, according to the complaint filed May 16 in Jefferson County District Court.
In addition, he incurred medical costs and experienced mental anguish, physical pain, suffering and physical impairment, the suit states.
Handy negligently failed to maintain control of his vehicle, failed to keep a proper lookout, failed to control his speed, drove negligently and drove inattentively, the complaint says.
In addition to Handy, Bonin names Angela Handy as a defendant. Angela Handy owned the vehicle Troy Handy drove at the time of the collision, but should never have lent her vehicle to a known reckless driver, Bonin claims.
In his complaint, Bonin is seeking a judgment in excess of the minimum limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
Jane S. Leger of Provost and Umphrey Law Firm in Beaumont will be representing him.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
