Suit blames crash on stop-sign runner

A Beaumont man has filed suit against the driver who he claims failed to stop at a stop sign, causing a collision.

Hortense Cantu claims he was driving west in the 2800 block of Blanchette Street in Beaumont on Oct. 24, 2009, when Eva Guidry, who was driving north in the 2300 block of San Jacinto Avenue in Beaumont, failed to stop at a stop sign, colliding with Cantu.

Because of the collision, Cantu experienced physical pain, mental anguish, disfigurement and physical impairment and incurred medical costs, according to the complaint.

Cantu blames Guidry for causing the collision, saying she negligently failed to keep a proper lookout, failed to yield the right-of-way, failed to safely stop the vehicle she drove and failed to keep her vehicle under control.

At the time of the collision, Cantu had insurance through defendant Farmers Texas County Mutual Insurance Co., which included a provision to protect him from a collision with an under insured driver.

Guidry was considered an under insured driver because her insurance policy did not provide enough coverage to cover Cantu's damages, the suit states. Cantu says he should have received the additional money from Farmers.

In his complaint, Cantu is seeking actual damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

Charlton P. Hornsby of Beaumont will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
