Plaintiff claims driver failed to yield right of way

GALVESTON - Octavio R. Sandoval Jr. has filed a $25,000 lawsuit against Mary Lou Ochoa in response to a two-vehicle accident that occurred two years ago in League City.

Court papers filed May 31 in Galveston County Court at Law No. 2 claim Ochoa caused the alleged wreck with Sandoval on June 9, 2009, by failing to yield the right of way to him.

The plaintiff was traveling westbound on E. League City Parkway and about to approach Bay Ridge Drive in the left lane while the defendant was turning from the same road to travel north on Columbia Memorial Drive.

Sandoval says the westbound light at the intersection was green while Ochoa notes the turn light also being green.

The suit believes the defendant was distracted at the wheel moments prior to the collision in question.

"The defendant said that when she looked down to grab her drink from the cup holder she looked back up and the turn signal was red," it states.

"The plaintiff struck the defendant's vehicle in the right door."

In addition to not yielding the right of way, Ochoa is faulted for failing to keep a proper lookout and failing to keep a safe distance between her and Sandoval.

A jury trial is requested.

Attorney Gregory W. Allen of Houston is representing the complainant, and Galveston County Court at Law No. 2 Judge Barbara Roberts is presiding over the case.
