Shreveport couple sues over 2009 tractor-trailer wreck

MARSHALL - A federal lawsuit has been filed concerning a 2009 tractor-trailer wreck in Marshall.

Shreveport residents Bennett Cady and Gloria Cady filed the personal injury lawsuit against Star Transportation and Jonathan Carnahan on May 26 in the Eastern District of Texas, Marshall Division.

According to court documents, the accident occurred on Oct. 25, 2009, as Bennett Cady was driving his vehicle east bound on Interstate 20 in Marshall.

Cady states he was in the outside lane of travel and was being followed by another vehicle that was driving by Lechaybreon Robinson. Defendant Carnahan was driving a tractor-trailer in the inside lane of travel and was attempting a lane change when he struck the Robinson vehicle.

After striking the Robinson vehicle, the defendant allegedly swerved and struck Cady's vehicle.

The defendant is accused of negligence for failing to maintain a proper lookout, failing to control speed, failing to maintain proper control of his vehicle, failing to maintain an assured clear distance and failing to properly and timely apply his brakes.

The plaintiff is seeking damages for physical pain and suffering, mental anguish, physical impairment, medical expenses, loss of earnings, disfigurement, loss of household services, loss of consortium, interest and court costs.

Cady is represented by Bruce A. Smith and T. John Ward Jr. of Ward & Smith Law Firm in Longview and William F. Kendig of Rice & Kendig in Shreveport, La.

A jury trial is requested.

U.S. District Judge David Folsom is assigned to the case.
