Attorney Tom Oxford withdraws from slip-and-fall suit

Plaintiff's attorney Tom Oxford has withdrawn from a slip-and-fall lawsuit filed against an area restaurant.

In June 2009, the Southeast Texas Record reported that Bertha Jimenez sued Kaware LP, doing business as Easy's.

Court records show that Jimenez, an employee at the eatery, was working on Sept. 26, 2008, when she slipped and fell in water that had been left standing on the floor, injuring her left wrist.

On May 13 Judge Donald Floyd, 172nd District Court, signed on order granting Oxford's motion to withdraw as attorney of record, court papers say.

No new attorney is on record and the order does not state why Oxford, an attorney for the Waldman Smallwood law firm in Beaumont, withdrew.

Jimenez is suing for her physical pain and suffering, mental anguish, loss of earning capacity and physical impairment, and incurred medical costs, the complaint says.

At the time of Jimenez's injury, Easy's was not a subscriber to the Texas Workers' Compensation Act.

Easy's went out of business in 2010.
