Red-light runner blamed for 11th Street wreck

A Lumberton man claims he and his child suffered severe injuries in a collision caused by a driver who ran a red light.

Bart Bendy filed a lawsuit June 9 in Jefferson County District Court against Billy R. Moore.

In his complaint, Bendy claims he drove south on 11th Street in Beaumont on June 11, 2009, when Moore, who drove west on Liberty Street, failed to obey a red light, causing Bendy to strike his vehicle "T-bone style."

Because of the collision, Bart Bendy and minor Spencer Bendy, who rode as a passenger in the vehicle, experienced pain, suffering, mental anguish and emotional distress, according to the complaint. In addition, Bart Bendy incurred medical costs and lost wages, the suit states.

Bart Bendy blames Moore for causing the collision, saying he negligently failed to keep a proper lookout, failed to timely apply his brakes and failed to obey a traffic control device.

In his complaint, Bart Bendy seeks an unspecified judgment, plus pre- and post-judgment interest at the maximum rate allowed by law, costs and other relief the court deems just.

Stephen T. Liss of Houston will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
