Orange residents sue over car crash
Two Orange County residents claim they suffered severe, debilitating injuries after a driver collided with them.
Rickey Gene Massey and Jamie Hargroder filed a suit June 20 in Jefferson County District Court against Glenn Allen McDaniel and McKenzie Tank Lines.
In their complaint, Massey and Hargroder claim Massey drove a vehicle in Jefferson County on July 1, 2009, when McDaniel, who drove a vehicle for McKenzie Tank Lines, struck Massey's vehicle. At the time of the collision, Hargroder rode as a passenger in Massey's vehicle, according to the complaint.
Because of the collision, Massey and Hargroder experienced physical pain, mental anguish and physical impairment and incurred medical costs, the suit states. They also lost earnings and incurred property damages, the complaint says.
Massey and Hargroder blame McDaniel for causing the collision, saying he negligently failed to keep a proper lookout, failed to maintain control of the vehicle, drove too fast, failed to apply his brakes in a timely manner, failed to exercise ordinary care, failed to turn his vehicle in an effort to avoid a collision and failed to keep a clear distance between his vehicle and Massey's. In addition, McDaniel negligently failed to drive within a single lane, according to the complaint.
In their complaint, Massey and Hargroder seek a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.
