League City couple fights landlords to get security deposit back

GALVESTON � A League City couple has filed suit against their landlords over the return of their security deposit.

Brenda Mirelez and David Aguilar claim Diana and Roy Mann refused to return their deposit check, which caused them actual and economic damages, according to a suit filed June 14 in Galveston County Court at Law No. 3.

According to the suit, Mirelez and Aguilar rented a house in League City from the Manns after their home was destroyed by Hurricane Ike. The lease agreement called for a $1,850 security deposit and monthly rent in the same amount.

The Manns have kept the couple's security deposit to cover repairs to the residence, but the plaintiffs claim no such repairs were made.

The defendants' retention of the deposit was made in bad faith and constitutes a breach of contract, the original petition alleges.

Mirelez and Aguilar say they suffered financial losses and mental anguish.

A jury trial is requested.

Attorney Kathleen Collins of Galveston is representing the plaintiffs.

Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
