Builder sues contractor over unpaid work in Seabrook

GALVESTON - WTL Builders Inc. is trying to recover approximately $8,500 from Watlee Construction Inc. of Texas and Sure Tec Insurance Co.

A lawsuit filed June 13 in Galveston County District Court says Watlee and Sure Tec owe WTL, doing business as Texas Fence Co., $8,450 for a work order in Seabrook.

According to recent court documents, WTL and Watlee had an agreement in which the plaintiff agreed to furnish fencing work and certain improvements to Carothers Coastal Garden while the defendant consented to pay the agreed upon contract sum.

The original petition insists the complainant "has performed all work and provided all services and materials required under the agreement, but the defendant has made only partial payment."

It further explains that WTL properly perfected its lien claim in accordance with the McGregor Act on the payment bond for the project in question.

The plaintiff has performed all conditions precedent to the validity of such claim, including but not limited to providing the requisite notices and filing the required claim affidavit, the suit says.

Sure Tec issued the bond.

Attorney Ted A. Cox of Houston is representing WTL, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
