Petition seeks deposition of teacher accused of sexually assaulting student

A petition seeking the deposition of a teacher who allegedly sexually assaulted a 15-year-old female student has been filed in Jefferson County District Court.

The petition was filed by two individuals identified as Jane and Mary Doe on July 11 and seeks the deposition of Clemente Spann.

According to the petition, Mary was a student at Central Medical Magnet High School. During classroom hours, Spann had taken her cellphone. When she attempted to retrieve it after class, he allegedly began rubbing her buttock.

In her suit, Mary says she elbowed him in the gut but Spann, not deterred by the action, then began cupping her breast.

The suit does not state when the incident occurred.

However, according to Channel 6 News, the incident occurred on Jan. 11, 2010 and Spann has been brought up on charges.

The petitioners are seeking Spann's testimony in anticipation of filing a lawsuit.

Beaumont attorney Clay Dugas represents them.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
