SHERMAN - A Wisconsin resident has filed a lawsuit against a collection agency after receiving numerous collections calls before 8 a.m.
Claiming violations of the Fair Debt Collection Practices Act, Joslynn Pelletier filed suit against the CMI Group on July 14 in the Eastern District of Texas, Sherman Division.
Pelletier states that CMI Group, a debt collector located in Denton County, made numerous collection calls, sometimes in excess of five times a day. The collections calls included calls made before 8 a.m. and calls made to Pelletier's workplace.
The defendant is also accused of informing a third party, Pelletier's mother, about the debt without consent.
The defendant is accused of violating the Fair Debt Collection Practices Act by calling Pelletier's place of employment, by using unfair or unconscionable means and by contacting a third party in collection with an alleged debt.
The plaintiff is seeking an award of actual damages, statutory damages, costs, interest and attorney's fees.
Pelletier is represented by David Lilley of Alex Simanovsky & Associates in Wichita Falls.
A jury trial is requested.
U.S. District Judge Michael H. Schneider is assigned to the case.
