GALVESTON - League City residents Robert James Beasley and Vera Ann Bila claim they were in an accident with a Kemah police officer and are suing the patrolman and the city, recent court documents say.
According to a lawsuit filed July 15 in Galveston County Court at Law No. 3, Matthew Louis Macik disregarded traffic rules and regulations when he collided with the plaintiffs at the intersection of Highway 146 and FM 518 last Oct. 13.
The original petition shows the complainants were crossing Highway 146 while Macik, who was reportedly on duty, traveled northbound in the turn only lane headed to said intersection at the time of the alleged incident.
It adds the officer drove at a high rate of speed despite not responding to an emergency nor activating his siren or emergency lights.
"The defendant Matthew Louis Macik failed to keep a proper lookout and hit the plaintiffs' vehicle," the suit says.
"Due to the defendants' conduct, the plaintiffs have suffered extreme injuries and sustained multiple damages."
Beasley and Bila were subsequently rushed to the hospital.
They consequently sue for physical pain and suffering, mental anguish, lost earnings and medical expenses.
A jury trial is requested.
Attorney Justin R. Gilbert of Angleton is representing the complainants, and Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
